BACKGROUND: 

On May 19, 2020, Clark County (County) renewed its lease with Bell Atlantic Systems (Verizon) for a wireless communication tower on ±1,200 square feet of land at Sunset Park (Lease) which originally expired on January 31, 2020.
                     
Upon execution of the new lease, Verizon was to pay holdover rent from the expiration date of January 31, 2020 to May 19, 2020. Payment was not made and the tenant balance continued to increase with applicable late fees. Notice of Defaults were issued July 8, 2021 and again on May 4, 2022. The terms of the settlement are as follows:

1.
                     Verizon shall pay the County $15,000 to settle all back-owed holdover and late fees.
2.
                     The Lease will be amended to clarify the late fee rate of 5% per month of any amount past due.

The Department of Real Property Management will present the First Amendment to Site Lease Agreement in a separate companion board agenda item.
