BACKGROUND: 

BPS Harmon, LLC (BPS) is constructing a three-story building addition with rooftop and exterior improvements (BPS Building) upon Assessor's Parcel Numbers 162-21-215-002 and 162-21-215-003. BPS has an approved Use Permit (UC-10-0608 with modifications through UC-21-0646 and AV-25-900023) which shows a connection and direct ingress and egress from the second floor of the BPS Building to the existing pedestrian overpass at the northeast corner of Las Vegas Boulevard South and Harmon Avenue.

Clark County has property rights over a portion of the property on which BPS intends to modify. This agreement will allow BPS to construct the modifications at the sole cost and expense of BPS. Modifications will include the removal of three glass rail panels on the public pedestrian bridge adjacent to the BPS Building on the south-facing direct ingress and egress entrance from the second floor of the BPS Building, in accordance with the plan approved and permitted by Clark County.

The District Attorney's Office has reviewed and approved the agreement as to form.
