BACKGROUND:
The District's treatment facilities utilize Turblex and Roots blowers in the water reclamation process. These blowers are vital to the District’s daily operation, and to ensure uninterrupted operation, a readily available source of specialized parts for regular maintenance and repair services is necessary. Turblex and Roots blower maintenance and repair services must be performed by factory-trained personnel to maintain optimum performance and reliability. Howden Roots, LLC., is the authorized sole source distributor of the specialized parts, and the only factory- authorized service center for maintenance and repair services of Turblex and Roots blowers.
Staff confirmed that Turblex and Roots blower parts, maintenance, repair, and training services are only available through its authorized sole source distributer, Howden Roots, LLC.
Staff recommends that the Board approve and authorize the General Manager to issue purchase orders to Howden Roots, LLC., for Turblex and Roots blower parts, maintenance, repair, and training services on an as needed basis, for as long as the competitive bidding exception applies. Staff will submit an annual report to the Board detailing incurred expenditures.
The following are pertinent provisions of the agreement:
• The term of the agreement is from the date of award and will continue for as long as the competitive bidding exception applies, with a price increase not to exceed 10% for each year of the contract term;
• The agreement includes the option to terminate or suspend for cause or convenience with advance written notice of intent.
On an annual basis, staff will verify that Howden Roots, LLC., is the authorized sole source distributor for the items being purchased under this competitive bidding exception and will report back to the Board if there is a change in Howden Roots, LLC's sole source status.
In accordance with NRS 332.115.1 (a) & (d), the competitive bidding process is not required because the parts, equipment and services can only be purchased from a sole source distributor. Howden USA Company dba Howden Roots, LLC., (LBE) currently holds a Clark County business license.
This agenda item has been reviewed and approved by the District General Counsel.
