BACKGROUND:

On December 1, 2020, the Board of County Commissioners approved and authorized the acquisition of a portion of Assessor's Parcel Number 140-26-103-007 (Obaama Mohammed) for construction of the Jim McGaughey Detention Basin, Collection Basin and Outfall project.  An offer was presented to acquire a portion of the property.  However, the property owner rejected the offer and claimed severance damages related to the remainder parcel due to the loss of acreage and, thus, submitted a counter offer for the property to be acquired in its entirety.  The settlement will eliminate issues related to severance damages and costs associated with possible litigation.

Authorization to approve and authorize the proposed settlement is now being sought from the Board.
